Motor Valley - Termes of use

PRELIMINARY CONDITIONS

Considering that:

- In accordance with the agreement signed by the Modena Chamber of Commerce and the Region Emilia-Romagna on August 24, 2006, the Modena Chamber of Commerce agrees to grant ownership of the "Motor Valley" brand and of the corresponding website to the Region Emilia-Romagna. The agreement also provides for the institution of a technical committee, designed for the management, diffusion, promotion and use of the above-mentioned brand;

- According to the same agreement, the "Motor Valley" brand represents a common identification mark of the Region Emilia-Romagna, and is meant to be used alongside logos of private and public organizations or institutions, business owners, events and facilities related to the subject. The "Motor Valley" logo cannot identify specific company products;


IT IS DECLARED THAT:

a. The Region Emilia-Romagna entrusts the Modena Chamber of Commerce with the management (free of charge) of the section of the http://www.motorvalley.it/ website titled "Businesses". This concession provides for the carrying out of research, monitoring and regular update activities of all companies related to the topic of "motors" located in any of the nine provinces of the region;
b. the criteria on which the concession of the "Motor Valley" trademark is based are defined as follows:
1. Any first-time user (private party) of the "Motor Valley" trademark in relation with projects strictly related to the topic of "motors" will have to submit an official application to the technical committee by filling out a form, to be downloaded on the http://www.motorvalley.it/ website. The committee will notify the applicant of the results of his/her application within 45 from the date of submission;
2. Any public party intending to launch promotional activities and occasional/recurring events related to the project called "Motor Land" within the Region Emilia-Romagna (law 135/01), will be allowed to use the trademark after notifying the technical committee. The latter will authorize any request following the so-called "silence=approval" principle within 15 days from the date of submission of the request;
3. any private party who has already been granted use of the Motor Valley trademark in relation to activities related to motors, may be able to use the trademark again upon notifying the technical committee. The latter will authorize any request following the so-called "silence=approval" principle within 15 days from the date of submission of the request.

In general, in case of events/activities held outside the Region Emilia-Romagna, the Motor Valley trademark will have to be used in combination with the APT Emilia-Romagna trademark, so as to emphasize the local character of the Motor Valley trademark.
